Effective April 1, 2023, the requirements for recovery under the provisions for recovery after a lapse of period will be relaxed from “having a legitimate reasons ” to “unintentional”.

With this relaxation, even careless lapse of period can be eligible for recovery.

(Requirements)

〇Within two months from the date when the procedure became available, and within one year after the expiration of the period (within six months for trademarks).

〇Submit a statement of reasons for recovery.

〇Pay the recovery fee.

Note that the recovery fee is expensive (patent: 212,100 JPY (as of April 1, 2023)).
